Terms of Use

These Terms of Use (the “Terms”) are a legal agreement between you and J&Z Solutions LLC (“Inspectoma,” “we,” “us,” or “our”) governing your use of the Inspectoma mobile application, website, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Inspectoma app on a device that you own or control, solely for your own business or professional purposes. You may not copy, modify, reverse engineer, distribute, sell, or create derivative works of the Service except as permitted by law.

You agree not to:

• Use the Service for any unlawful or fraudulent purpose.
• Upload content that infringes others’ rights or violates applicable law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Use the Service to send unsolicited communications in violation of anti-spam or telemarketing laws.

You retain ownership of the inspection reports, photos, notes, and other content you create through the Service (“Your Content”). You grant us a limited license to host, process, and transmit Your Content as necessary to provide the Service.

Inspectoma is a documentation and reporting tool. The inspections, findings, conclusions, and professional judgments in Your Content are yours, not ours. You are solely responsible for the accuracy, completeness, legality, and use of Your Content, including any reports you deliver to clients, and for complying with the licensing, regulatory, and professional standards that apply to your work.

Certain features may require payment or a paid subscription. Fees, billing periods, and renewal terms will be disclosed at the time of purchase. Unless stated otherwise, fees are non-refundable except as required by law. If you purchase through a third-party app store (such as the Apple App Store or Google Play), that store’s billing, refund, and subscription-management terms also apply.

The Service integrates with third-party services (for example, payment processing and email/SMS delivery). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.

The Service, including its software, design, logos, and content (other than Your Content), is owned by J&Z Solutions LLC and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSPECTOMA AND J&Z SOLUTIONS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.

You agree to indemnify and hold harmless J&Z Solutions LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising from these Terms or the Service, except where prohibited by applicable law.

If you download the app from the Apple App Store, the following also applies and, in case of conflict with the rest of these Terms for App Store usage, controls:

• These Terms are between you and J&Z Solutions LLC only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app. Any support questions should be directed to support@inspectoma.com.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• J&Z Solutions LLC, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal requirements, and claims under consumer-protection or privacy law.
• J&Z Solutions LLC, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

We may update these Terms from time to time. When we do, we will revise the “Effective date” above and, for material changes, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
